The complainant – Jitendra submitted a written
complaint against Gayatribai, Nageshwar, and Omprakash alleging that with
the common intention, they performed his (Jitendra) marriage
with Gayatribai in Jaora court on 9th September 2020.He
submitted that he met Nageshwar for his marriage and later he was introduced to
Gayatridevi and Omparakash. But after 5-6 days of the marriage, Gayatribai fled
away from his house with all her belongings and is missing since 14.9.2020.Since
he had given 1,50000/- to one Mukesh for performing this marriage and Mukesh
did so through Notary Public on 9.9.2020 and also signed as witness to the
marriage, Jitender inquired about Gayatribai from Mukesh . Mukesh threatened him
to implicate him under rape case; hence he filed case against Mukesh who had
been in jail since September 2020.
Court held job of Notary is defined under Notary Act. The
Notaries/Oath Commissioners not authorized to execute
marriage/divorce documents.
