Can a consumer ask for refund of fee given to the advocate in case advocate does not perform his duty. Advocate argued that he is entitled to retain the fee because vakalatnama was signed by the client by giving him power of attorney and he had given valuable time to the documents for reading and understanding the case .National Commission rejected the plea on the ground there cannot be any fee when there is no performance .Advocates plea that complainant has already made complain to bar council also was rejected as the complaint before the Bar council is for the purpose of checking misconduct on the part of its member.

Ever since the act has come into force ,at one hand the Apex court went on giving broader description and wider scope to the act through its various pronouncements ,at the same time ,it also faced numerous problems and several attacks on the authority of these forums from big business houses.The most attacking thing consumer protection act ever faced was an outburst of big business houses in the form of a case challenging the validity of the consumer protection act itself when a case was filed in the court in the year 1998 before karnataka state commission and then travelled to >high court of karnataka s. The questions were raised as to whether Lok Sabha is empowered to pass such an act by which consumer forums run like parallel courts to/against the civil courts with much more discretionary powers...

Employment of judges after retirement

The Commission was of the view that it was necessary to safeguard the independence of the Supreme Court Judges by enacting a law barring further employment except as ad hoc Judges of the Supreme Court under Art. 128. M.C. Setalvad, the Chairman of the First Law Commission wrote in his autobiography: "The Commission had, after careful consideration expressed the unanimous view that the practice of Judges looking forward to or accepting employment under the Government after retirement was undesirable as it could affect the independence of the Judiciary. We therefore recommended that a constitutional bar should be imposed on Judges accepting office under the Union or State Governments similar to the bar in the case of the Auditor and Comptroller-General and members of Public Service Commissions."[1]...
