Law on fee refund by advocate

Coaching centers in the country generally charging full term payment for the course at the time of commencing coaching .Do the students have right to get refund if coaching not found up to the mark. National Commission rejected the plea of their pre-condition of entire payment for two years course in one go stating therein that condition was one sided and biased and  against natural justice and to be considered unfair trade practice.

·         Can a consumer ask for refund of fee given to the advocate in case advocate does not perform his duty. Advocate argued that he is entitled to retain the fee because vakalatnama was signed by the client by giving him power of attorney and he had given valuable time to the documents for reading and understanding the case .National Commission rejected the plea on the ground there cannot be any fee when there is no performance .Advocates plea that complainant has already made complain to bar council also was rejected as the complaint before the Bar council is for the purpose of  checking misconduct on the part of its member.
