UNFAIR TRADE PRACTICES-PROMISE TO PROVIDE WORK PERMIT
FAILS
National Commission in their order dated 1.4.2014 held Ganga Immigration
and Education Services Pvt. Ltd indulging into unfair trade practices for not
providing work visa as per the promises made to the complainants .
The facts leading to this case are that complainants were allured through
the advertisement given by the opposite party for providing work visa /permit
in Malaysia.Complainats paid processing fee and they were informed that their
visa was confirmed. and subsequently their flight was booked for
26.12.2012.Later on their representative stated that they are allowed to go on
tourist visa which shall be converted into work visa within 15 to 30 days
and suggested to make part payment of Rs 90,000/-for further services.
Complainants made this payment and were flown to Malaysia. They
were made to work as labors there and had a tough time, struggled for survival
in an unknown country without job. They could return back to India only after
obtaining emergency certificate with the help of Indian high commission.
Complainants now asked for their refund which was refused by the opposite
parties. This led to a litigation which went up till National Commission
.National Commission confirmed the
orders passed by the District Fora and State Commission which was as follows:
To pay an amount of Rs 1, 40,000/- paid towards services to the
complainants...
To pay Rs 40,000/- which was spent by them in Malaysia while their stay.
To pay an amount of Rs 50,000/- towards compensation for the harassment
caused to them
To pay Rs 11000/- as cost of litigation.
Apart from confirming the above order passed by the State Commission,
National Commission further imposed a cost of Rs 1, 00000 out of which 25000/-
to be paid to each complainant [two] and balance 50000/- to be deposited in
consumer welfare fund.
