Are Consumer Commissions going to suffer power conflict with CCPA ?

1.     Dealing with same issues /complaints, still Both Differ

·        Commissions are to adjudicate individual complaints on the basis of individual facts ,grievance and relief sought.

·        CCPA takes up matter as class action looking into over all situation and practice being followed by business entities

 

·        Relief given to complainat benefits only the one who sought relief and not available to all consumers suffering from similar grievance or to those who filed class action case

·        No monetory benefit to individual or the complainants raising class action CCPA takes up administrative action as per Rules and punishes the erring entity

 

·        It’s a judicial order giving relief to consumer by repayment of  loss, compensating for mental agony,cost of litigation & Compensating incidental losses 

·        CCPA takes administrative action as per Rules which are not judicial orders but with power conferred by the Act,does not pay compensation to the complainant  

 

·        Commissions can set aside unfair clauses in the agreement and struck down and makes its own observations and judicial order

·        CCPA can contact Commission for this purpose if finds unfair clause in any agreements coming to heir notice

 

·        Consumer commissions can admit cases filed by state ,center ,Consumer Associations ,NGO ,or Consumer welfare organisations and even by CCPA

·        CCPA can be a complainant before the Consumer Commission for any violation of Consumer  Rights

 

2.     Consumer Commissions are Courts doing judicial functions

 CCPA is a Regulatory Body which  Regulates that Consumer Protection Act and its provisions are followed by the Market and consumers are getting all benefits ,facilities and remedies to Consumers as available to them by law 

 

3.     Consumer Commissions are totally independent for their judicial functioning

Regulatory Body is an independent Body working for the cause of consumers but under Ministry of Consumer Affairs
